El régimen de los minerales de los fondos marinos : términos y condiciones de una renegociación

Abstract

Since the 1982 United Nations Convention on the Law of the Sea established the regime applicable to the exploration and exploitation of the mineral resources of the seabed located outside the limits of national jurisdiction, many important events have taken place. This set of experiences has led to the question of whether it would not be appropriate to proceed with a renegotiation or complementation of the Convention regime, seeking a new consensus. This article examines the terms and conditions under which a renegotiation of this nature would be viable, taking into account the underlying interests of the main sectors involved in the issue and the need to separate what is real and rhetorical in the positions that until now have been expressed.
